Terms of Use

These Terms govern access to the designFlow websites, cloud workspace and mobile applications.

Important

designFlow helps professionals document project work, organize media and prepare reports. You remain responsible for the accuracy of project records, AI-assisted results and materials shared with clients.

1. Agreement to these Terms

These Terms of Use (“Terms”) are an agreement between you and Individual Entrepreneur Anna Aleksandrovna Maksimova, OGRNIP 319508100325484 (“designFlow”, “we”, “us”). They apply to the designFlow websites, web application and mobile applications for iOS and Android (together, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you use the Service for a company or another person, you confirm that you are authorized to accept these Terms on their behalf. If you do not agree, do not use the Service.

The English version applies to the English and Spanish interfaces until a separate Spanish translation is published. Mandatory consumer rights under the law applicable to you are not limited by these Terms.

2. Provider and scope of the Service

designFlow provides a cloud workspace for professional project management, including projects, visits, notes, tasks, issues, media, documents, client reports and optional AI-assisted tools. Features may differ by platform, plan, country and release version.

When the mobile app is obtained through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement governs the license to that app unless another license is shown by Apple. These Terms separately govern the designFlow account, cloud Service, project content and AI functionality.

3. Accounts and access

  • You must provide accurate account information and keep your email account and devices secure.
  • Login codes, passwords, sessions and private report links must not be shared with unauthorized persons.
  • You are responsible for activity performed through your account unless you promptly notify us of unauthorized access.
  • You may not create accounts using another person’s identity or use automated means to create or access accounts without our written permission.

We may require identity or ownership verification before acting on a sensitive account request.

4. Your content

You retain ownership of content you upload or create in the Service (“User Content”). You grant designFlow a limited, non-exclusive right to host, copy, transmit, convert, display and otherwise process User Content only as needed to provide, secure and improve the Service and to perform actions you request.

You control whether to generate or share a client report. A person who receives an active private link may be able to view its contents. You are responsible for selecting appropriate recipients and removing information that should not be shared.

You confirm that you have the rights necessary to upload and process User Content and that it does not violate law, confidentiality duties, intellectual-property rights or the rights of another person.

5. Personal data about clients and other people

Projects may contain names, addresses, photographs, voice recordings and other information about clients, contractors, employees or visitors. You are responsible for deciding whether collecting and uploading that information is appropriate and for obtaining any permission or providing any notice required by applicable law.

Do not secretly record people where recording requires notice or consent. Do not upload unnecessary sensitive information, access credentials, full payment-card data or content that you are not authorized to process.

6. Optional AI features

AI features require separate permission in the app before selected data is sent for AI processing. They may transcribe recordings, recognise information in photographs, suggest tasks or issues, answer questions and generate report summaries.

AI and speech-recognition results are probabilistic and may be inaccurate, incomplete or unsuitable for a particular purpose. They are drafts and organizational aids, not professional, legal, financial, engineering or safety advice. You must review outputs, correct transcripts and verify prices, article numbers, codes, tasks and conclusions before relying on them or sharing them with a client.

You may withdraw AI permission in the app. Withdrawing permission stops new optional AI requests but does not automatically delete results already stored in your workspace.

7. Plans, payment and taxes

Some functions may be free, trial-based or available only under a paid plan. The current price, term, included limits, renewal or cancellation conditions and available payment method are displayed through the authorized purchase channel before purchase.

Purchases made through an app marketplace are also subject to that marketplace’s billing, cancellation and refund rules. Other purchases may be governed by checkout or order terms presented by designFlow. You are responsible for applicable taxes unless the purchase flow states otherwise.

Failure to pay may result in restriction of paid functions, but does not waive amounts already due or legal retention obligations.

8. Acceptable use

You must not:

  • use the Service unlawfully, fraudulently or to infringe another person’s rights;
  • upload malware or content intended to disrupt, overload or compromise the Service;
  • probe, bypass or defeat access controls, rate limits or security measures;
  • access another user’s workspace or derive credentials without authorization;
  • reverse engineer the Service except where applicable law expressly permits it;
  • resell or provide the Service as your own hosted product without written permission;
  • use AI functions to create unlawful content or make high-impact decisions about individuals without appropriate human review and legal authority.

9. Availability, synchronization and changes

We work to keep the Service available, but uninterrupted or error-free operation is not guaranteed. Connectivity, device storage, third-party providers and maintenance can affect synchronization, media processing, email delivery and AI functions.

You should verify that important records have synchronized and retain independent copies of materials that are critical to your business or legal obligations. We may add, change or discontinue functions where reasonably necessary, including for security, compliance and compatibility.

10. designFlow intellectual property

The Service, software, interface, design, documentation, trademarks and other materials supplied by designFlow are owned by or licensed to designFlow. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your own professional or internal business purposes.

No rights are granted except those expressly stated. Your ownership of User Content is not transferred to designFlow.

11. Third-party services and links

The Service relies on hosting, storage, email, diagnostics, speech-recognition and AI providers and may link to external websites. Third-party services have their own terms and privacy practices. We are responsible for selecting providers with reasonable care but do not control an external website you choose to visit.

12. Suspension, termination and account deletion

You may stop using the Service at any time. You can initiate deletion from Profile → Delete account in the mobile app. Account access is revoked when the request is accepted, and associated data is normally processed for deletion within 2–3 business days, subject to records that must be retained by law. Details are in the Privacy Policy.

We may suspend or limit access where reasonably necessary to prevent harm, investigate unauthorized use, comply with law, address non-payment or respond to a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to remedy the issue.

Sections intended by their nature to survive termination—including ownership, payment obligations, disclaimers, liability and governing law—remain in effect.

13. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”. We do not promise that every feature will always be available, that synchronization or third-party processing will be immediate, or that AI output will be accurate.

Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded for a consumer in their country.

14. Limitation of liability

To the maximum extent permitted by applicable law, designFlow is not liable for indirect, incidental, special or consequential loss, loss of profit, opportunity or reputation, or loss caused by a user’s failure to verify AI output, protect access links or maintain appropriate backups.

Any limitation applies only to the extent allowed by law and does not limit liability that cannot legally be limited, including liability for intentional misconduct or other mandatory grounds.

15. Governing law and disputes

These Terms are governed by the laws of the Russian Federation, without prejudice to mandatory consumer-protection or data-protection rights applicable in your place of residence.

Please contact us first so we can try to resolve a dispute. If it cannot be resolved, it may be submitted to a competent court under applicable procedural law. Consumers retain any right to bring a claim in a court or use a remedy that mandatory local law provides.

16. Changes to these Terms

We may update these Terms to reflect changes in the Service or law. The current version and effective date will remain available at this URL. If a material change requires your renewed acceptance, we will request it separately.
